ENUGU 2023: COURT REFUSES TO GRANT INJUNCTION RESTRAINING NYSC FROM APPEARING BEFORE THE ELECTION TRIBUNAL
Abuja – The Federal High Court, Abuja presided over by Justice Inyang Ekwo resumed hearing in the case filed by Peter Mbah against the NYSC in suit No. FHC/ABJ/CS/611/2023.
Peter Mbah, represented by Emeka Ozoani SAN, sought to move an application for an interlocutory injunction restraining the NYSC from appearing before the Enugu State Governorship Election Petition Trubunal to give evidence with respect to the case of alleged forgery of NYSC Certificate No. A808297 presented by Peter Mbah to INEC.
However, the judge turned down the application. He asked the SAN to forget about the injunction and concentrate on the main suit. The court adjourned the case to July 11, 2023 to hear the preliminary objection challenging the competence of the suit filed by the NYSC.
With this development, the NYSC is expected to appear before the Enuhu State Governorship Election Petition Tribunal on 7th July 2023.
