BREAKING! APPEAL COURT REINSTATES LP’S OKOLIE, HALTS ELUMELU ‘S RETURN TO THE GREEN CHAMBERS

Abuja – The Court of Appeal sitting in Abuja has voided the ruling of the Delta State National Assembly Elections Tribunal, reinstating Hon Ngozi Okolie of the Labour Party( LP) as winner of the Oshimili North/Oshimili South Federal Constituency election.

The appellate court on Thursday quashed the ruling of the tribunal which nullified Okolie’s election to declared Rt. Hon. Ndudi Elumelu(PDP) as the valid winner of the election on the ground that the Labour Party candidate failed to resign from his appointment as Special Assistant to the Delta State Governor, before contesting the election, as stipulated by the constitution.

However, the appellate court upheld the argument of Okolie’s counsel, Mahmud Magaji(SAN), that the Labour Party candidate was duly elected based on the declaration by the Independent National Electoral Commission (INEC) that he polled 54,879 votes to beat his closest rival, Elumelu of the People’s Democratic Party, who garnered 33,456 votes.
